NATURE OF THE PROCESS

In collaborative practice each party has an attorney, but there is a contract signed by all participants at the outset that requires negotiations to be conducted in a manner that promotes teamwork and collaboration.  Other professionals, such as mental health coaches and/or financial specialists can be added to the process as needed. If an agreement is not reached, neither of the attorneys may represent their client in any resulting court action.

BENEFITS

Provides for appropriate professional assistance in the process.
Avoids many of the problems of the adversarial system.
Each party always has full access to his or her attorney.

RISKS

The process at times can be somewhat bureaucratic.
At times extraneous professionals may become involved.
